Terms of Service
The terms governing your use of the Menly platform.
Acceptance of terms
By creating a Menly account or using any part of the Menly platform, you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the platform.
These Terms form a binding contract between you (or your organisation) and Menly SA, Geneva, Switzerland. We may update them from time to time — you will be notified by email and the effective date will be updated below.
Your account
You must be at least 18 years old and have authority to bind your organisation to create an account. You are responsible for all activity under your account.
You must provide accurate registration information and keep your password secure. Notify us immediately at security@menly.ch if you suspect unauthorised access.
One person may hold only one personal account. Organisations may hold one account per Menly organisation entity.
Permitted use
You may use Menly to create, manage, and publish digital menus for legitimate food-service businesses. Personal, non-commercial use is also permitted within Free plan limits.
You must not use Menly to publish menus containing illegal content, fraudulent pricing, or content that violates third-party intellectual property rights.
You must not attempt to reverse-engineer, scrape, or abuse the platform in a way that degrades service for other users.
Your content
You retain ownership of all menu content, photos, and text you upload to Menly. By publishing it, you grant Menly a limited licence to host, display, and deliver your content to guests via the platform.
You warrant that your content does not infringe any third-party rights. Menly is not responsible for content accuracy (e.g., allergen declarations) — that responsibility remains with you.
We reserve the right to remove content that violates these Terms or applicable law.
Plans and billing
Paid plans are billed monthly or annually in advance in Swiss Francs (CHF) via Stripe. Prices are shown inclusive of applicable taxes.
Upgrades take effect immediately on a prorated basis. Downgrades take effect at the end of the current billing cycle.
You may cancel at any time. No refunds are issued for unused portions of a billing period, except where required by Swiss consumer law.
Menly may change plan pricing with 30 days notice. You may cancel before any price change takes effect.
Service availability
We aim for 99.5% monthly uptime but do not guarantee uninterrupted availability. Scheduled maintenance will be announced in advance where possible.
Guest menu page availability depends on a valid published menu. If you delete your account, guest pages are taken offline.
Termination
You may delete your account at any time from your account settings. All data will be removed within 30 days per our Privacy Policy.
Menly may suspend or terminate accounts that violate these Terms, engage in fraud, or fail to pay for a paid plan after a 14-day grace period.
Limitation of liability
To the maximum extent permitted by Swiss law, Menly's liability for any claim arising from your use of the platform is limited to the fees you paid in the 12 months preceding the claim.
We are not liable for indirect, incidental, or consequential damages including lost revenue or guest complaints arising from menu inaccuracies.
Governing law
These Terms are governed by Swiss law. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Geneva, Switzerland.
If you are a consumer resident in the EU, you also have the right to use the EU Online Dispute Resolution platform.
